Terms and Conditions for That Good Good Market San Diego

Welcome toThat Good Good Market! These terms and conditions ("Terms") apply to your participation in That Good Good Market ("TGGM"). By participating at TGGM, you agree to be bound by these Terms. Please read these Terms carefully before participating in at TGGM.
Market Participation
(a) Eligibility:
Vendors must only bring items to sell that have been listed on their application and approved by TGGM. NO animal products, food or otherwise are allowed. This is an ECO-FRIENDLY event, it is preferred that you use no plastic or styrofoam (straws, containers, bags, etc). Food vendors should use eco-friendly straws. Perishable items are not the responsibility of TGGM under any conditions. TGGM reserve the right to refuse or revoke participation of any vendor who does not meet our eligibility requirements.
(b) Stall fees:
Vendors must pay their stall fee no later than 7 days in advance to secure a space at TGGM. Please view our Refund Policy for further information.
(c) Set-up and breakdown:
Vendors are responsible for setting up and breaking down their stalls. Vendors must have their booth set up no later than 15 minutes prior to event start. Vendors may not tear down their booth any earlier than event end time and are responsible for leaving the area in the same condition it was found, including garbage disposal from their own station.
(d) Compliance with laws:
Vendors must comply with all applicable laws and regulations, including health and safety standards, and must obtain any necessary permits, insurances or licenses.
Food vendors must obtain the San Diego TFF Vendor Permit.
All vendors must obtain insurance and add That Good Good Market and the location as additionally insured.
Market Rules
(a) Product quality:
Vendors must sell only locally grown or produced food and products that meet our quality standards.
(b) Pricing:
Vendors must price their products fairly and accurately. All food vendors must provide a list of their offerings and the pricing prior to event start.
(c) Sales tax: Vendors are responsible for collecting and remitting sales tax on their sales, as required by law.
(d) Behavior:
Vendors must behave in a professional and courteous manner and must not engage in any behavior that could be harmful or offensive to other vendors or customers. Vendors who are behaving in a wrongful manner will be removed from the event without refund and not welcome back to TGGM.
(e) Marketing materials:
All vendors must promote their attendance at TGGM. At the event vendors may not distribute promotional materials outside of their booth unless they have been given prior approval by TGGM to do so.
(f) Smoking:
Smoking is prohibited at the Market.
(g) Children: Children under the age of 16 must be accompanied by an adult at all times.
Liability and Indemnification
(a) Liability:
We are not responsible for any injury, loss, or damage that occurs to vendors, customers, or their property at the Market.
(b) Indemnification:
Vendors agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of their participation in the Market.
Termination and Cancellation
(a) Termination:
We reserve the right to terminate a vendor's participation at TGGM at any time for any reason.
(b) Cancellation:
We may cancel TGGM in the event of extreme weather conditions, unforeseen circumstances beyond our control, or for any other reason. In the event of cancellation, we will issue a full refund or credit of stall fees to vendors.
Changes to Our Privacy Policy
(a) Modification: These terms and conditions may be modified by TGGM at any time. Any modifications will be effective immediately upon posting on the TGGM website, and you waive any right you may have to receive specific notice of such modifications.
(b) Governing law:
These Terms shall be governed by and construed in accordance with the laws of the state or territory where the Market is located.
(c) Severability:
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
(d) Entire agreement:
These terms and conditions, together with the vendor application and any other documents or agreements referenced herein, constitute the entire agreement between you and TGGM regarding your participation in the market.
